<p>The lawsuit singled out Voice Touch, Inc. as the primary telemarketer and Transontinental Warrany, Inc. as the warranty firm. Both of these companies operate out of Florida. Unfortunately, The Telemarketing Lawsuit Depository is of the opinion that the FTC has it all wrong. It is very probable that the accused parties are resopnsible for a number of illegal telemarketing calls. However, if your going to swing such a big hammer, why not swing at the biggest target.</p>
<p>The evidence submitted through this website was used in our private investigation. We have had some VERY valuable leads, thanks to all of the users of this website. These leads have pointed to Missouri based warranty companies, and to the telemarketing company C1F Marketing, which has several locations, including California. This was confirmed by a phone call to a Missouri based warranty company where our investigators posed themselves as interested marketing partners. In order to &#8220;size up the competition&#8221; we asked &#8220;which outbound call services do you currently use?&#8221;. The response to this question included C1F Marketing.</p>
<p>The majority of reported calls led back to Missouri based warranty companies, which leads us to believe that Voice Touch, Inc. and Transcontinental Warranty, Inc. are not the big fish.</p>

We believe that this is the same telemarketing agency that is being used by automobile warranty companies such as Vehicle Services, Inc. (previously linked to 800-219-7425) and Consumer Direct Warranty Services. If you are being called by (800) 168-4861, keep reading.</p>
<p><strong>How do you we know this?</strong> When we WERE getting the phone calls, we were getting them from SEVERAL phone numbers. Once we followed the <a href="http://www.telemarketinglawsuit.com/evidence-collection" target="_blank">script</a> and found the name of the company selling the warranties, then threatened them with legal action, <strong>they stopped calling</strong>. <strong>ALL OF THE NUMBERS STOPPED CALLING</strong>. Thus we have concluded that the same company was calling, regardless of the number they were calling from.</p>
<p>Following the same logic&#8230;Many of you have received calls from 800-219-7425. Recently, the same people submitting evidence about calls from this number are submitting evidence about calls from <strong>800-168-4861</strong>.</p>
<p><strong>What kind of information do we still need?</strong> We need you to continue to follow the <a href="http://www.telemarketinglawsuit.com/evidence-collection" target="_blank">script</a>. Continue to attempt to find out the name of the company selling the warranties. That way we can link the numbers (used by the telemarketing agency) with the warranty sales company (client of the telemarketing agency). Look through your phone records and see if you are being contacted by both 800-168-4861 and 800-219-7425. Information on this phone number was submitted by some of the same users who submitted information on the number that was linked to <a href="http://telemarketinglawsuit.com/car-warranty-telemarketing-scam/800-219-74258002197425-and-580-822-33865808823386-solved">Vehicle Services</a>. I believe that <strong>251-947-8966</strong> is being used by the same telemarketing firm that used <a href="http://telemarketinglawsuit.com/car-warranty-telemarketing-scam/800-219-74258002197425-and-580-822-33865808823386-solved" target="_self">800-219-7425</a>.</p>
<p>Between the period of approximately August 2008 through November 2008, I was <span>receiving</span> the <strong>Automobile <span>Warranty</span> Telemarketing </strong>calls. The calls came from many different phone numbers and there is evidence that those phone numbers were linked to several telemarketing firms. After I revealed the company attempting to sell me the warranties, I aggressively threatened them with legal action&#8230;THE CALLS STOPPED!!!</p>
<p>The interested part about this is that ALL of the calls stopped by merely talking with one company (albeit several times). Regardless of the fact that I was being called by multiple phone numbers and by multiple telemarketing firms, the calls ceased after threatening one warranty company with legal action. This gives me reason to believe that all of the numbers, and all of the telemarketing firms, were linked to <strong>one warranty company</strong>.</p>
<p>This case is no different. The users of The Telemarketing Lawsuit Depository contacted by 800-219-7425 have also been contacted by 251-947-8966 regarding the same Car Warranty Telemarketing Scam. Based upon the previously mentioned deductions, <strong>Vehicle Services, Inc. is responsible for BOTH of the phone numbers</strong>.</p>

			<content:encoded><![CDATA[<p>A user submitted this information last night regarding the <strong>Arrowhead Investment Fraud Case</strong>. This looks like a case of an attempt at <strong>Investment Fraud </strong>via telemarketing (called from 703-574-5308). By all means, please educate yourselves about this. This is much more serious than the Car Warranty scam that we often discuss here at The Telemarketing Lawsuit Depository. The following information was submitted:</p>
<p>&#8220;They told him that they were the US Legal Dept Financial Crime Division and that he had committed fraudulent activities in order to obtain money and that there was a warrant for his arrest. They then said that my husband owed 3 hundred dollars to an Arrow Head Investment and it was for a loan. They have all of his personal information which made us want to believe them. But my husband is not a fool so he began to ask then questions and try and get information from them and he basically told them that he wasnt going to pay them any money with out any documentation that we actually owed them this money. Then this guy said &#8220;let me tell you that you are an a**hole&#8221; and then hung up&#8230; The only information that he did get out of them was the crap they feed us about being the us government and a web site of www.fincin.gov which is the wrong address anyways the real Us Legal Dept Fincail Crimes Divisions web site is www. fincen.gov. We called our local police dept and reported this scam to them and then we called the real US Legal Dept Financial Crimes People and filed a report with them and let them know what these people were doing.&#8221;</p>

It is followed by a discussion of the lawful amount that can be awarded to a plaintiff in a telemarketing lawsuit case. The more evidence we collect, the more damage we can do.</p>
<p><a title="WDAY6 Article" href="http://www.wday.com/news/index.cfm?id=7194" target="_blank">WDAY News 6</a> &#8211; In light of a telemarketing lawsuit brought filed against them, seven (7) telemarketing agencies in California, Kansas, Ohio, and Florida have settled with the state of North Dakota. Like the companies discussed in previous posts, these telemarketers used prerecorded messages to make telemarketing calls. The settlements ranged from $1,000 to $5,000.</p>
<p>That&#8217;s all? The <a title="TCPA" href="http://telemarketinglawsuit.com/about" target="_self">TCPA</a> two (2) separate portions for Private Right of Action. One portion pertains to subsection b) &#8220;Restrictions on use of automated telephone equipment&#8221;, and the other to subsection c) &#8220;Protection of subscriber privacy rights&#8221;. Each subsection allows for the collection of $500 per violation of that subsection (b or c). Furthermore, if you can prove that the telemarketer &#8220;willfully or knowingly&#8221; violated the subsection, the recovery amount could be increased to up to $1,500 dollars per violation!</p>
<p>So if you get a prerecorded phone call to your cell phone, and you are on the Federal Do Not Call List, then the telemarketer has violated both subsections of the TCPA and you are eligible to sue for $1,000. Then, if you can prove that the defendant &#8220;willfully or knowingly&#8221; violated the TCPA, you are eligible for up to $3,000. If they called you ten (10) times and they always violated both sections, you are eligible for up to <strong>$30,000</strong>!!!</p>
<p>How do you prove that they &#8220;willfully or knowingly&#8221; violated the subsection? Well&#8230;It could be possible that you recently were put on the Do Not Call List. In this case, the telemarketers may not have updated their database, which is required every month or so, and therefore they did not willfully or knowingly violate this subsection (Subsection c). However, if you ask them to put you on their &#8220;do not call list&#8221; the first time they call you, and they call you again, no matter what period of time has passed, then you could potentially prove that they &#8220;willfully or knowingly&#8221; violated this subsection of the TCPA.</p>
<p>As far as Subsection b goes, there is really no excuse that could prove the defendant did not &#8220;know&#8221; they were violating the law. If you get pulled over by a police officer for speeding, and your excuse is &#8220;I didn&#8217;t know the speed limit&#8221;, are you likely to not receive a ticket? No&#8230;you will most likely become a subject of laughter. Ignorance is not an excuse to break the law. They could not give me the name of the <strong>telemarketing agency</strong> that owns the phone numbers, however, they did confirm that two agencies each owned three (3) of the six (6) phone numbers that are calling from Michigan.</p>

<p>(616) 980-2687: (11/18/2008) Call terminated.</p>
<p>(231) 732-2960: (10/28/2008) Call terminated. Google results show the number led to Saferide Warranty, Inc. for one telemarketing victim.</p>

<p>The following is a call log from the 11/13/2008 phone call placed to an unnamed party from Telemarketing Agency A.</p>
<p>Recording: &#8220;this is the third and final notice that the factory warranty on your car is about to expire&#8230;Press one to&#8230;&#8221; Did not identify name, contact information, etc..</p>
<p>I pressed one (1) and was transferred to a representative who took down my name and vehicle information. He then transferred me to Mr. Carlos Dean. Mr. Dean was going to get more information from me so that he could get the best warranty for me. He proceeded to tell me about the cost of the policy and said it would be $495 now and then a monthly payment of 139.17 for 18 months. He said that the warranty would be for 4 years or 100,000 miles. He told me I could pay by credit/debit card or electronic check. I then told him that I was uncomfortable giving my credit card information out over the phone/Internet, and he stopped me and said that he understands my fear of identity theft, etc&#8230; but that his company was backed by the Better Business Bureau and was FCC certified, etc&#8230; he then told me that the call was being recorded so that there was a record and all my information would be secure. This was the first time I was made aware that the call was being recorded. I then asked him about the electronic check. He told me I just give him my routing number and my account number and then void out that check. He said, for my records I could make the check out to &#8220;Automotive Warranty Solutions&#8221;. This was the first time I was informed of who was actually calling me. I proceeded to ask for an address where I could send the check and he told me that I could not mail in the check and I would have to pay by the aforementioned methods or I would not be able to get the warranty. I told him I did not have my car or checkbook with me and then asked for a number that I could call back when I get off of work. He did not easily give up that phone number. After some persuasion, he provided me with a phone number at which I could reach him. I told him I would call back before 6.</p>
<p>During my conversation with Mr. Dean, he did not notify me that I was being recorded until approximately 5 minutes into the phone call.</p>
